Terms of Service

These Terms of Service ("Terms") govern your use of the Meet Pete platform, the meetpete.work website, and related services (collectively, the "Services"), provided by Third Place Pools Corp, a Washington State corporation ("Meet Pete," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. The Services

Meet Pete provides AI-powered answering, voice agent, SMS, and field-service software designed for trade businesses (such as plumbing, HVAC, electrical, and similar contractors). The specific features available depend on the plan you subscribe to and any written order form between you and Meet Pete.

2. Accounts

To use the Services, you must create an account and provide accurate, current, and complete information. You are responsible for safeguarding your credentials and for all activity under your account. You must notify us immediately of any unauthorized use. You must be at least 18 years old and authorized to bind the business you represent.

4. Customer data

You retain ownership of all data you submit to the Services or generate through your use of the Services ("Customer Data"). You grant Meet Pete a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process Customer Data solely as necessary to provide the Services to you, to maintain and improve the Services, and to comply with legal obligations. We may use de-identified, aggregated data for product improvement and analytics.

You represent and warrant that you have all rights and consents necessary to provide Customer Data to Meet Pete and to allow Meet Pete to process it as contemplated by these Terms.

5. SMS & voice compliance

The Services include the ability to send SMS messages and place voice calls. You acknowledge that you are responsible — as the sender of record — for compliance with all applicable laws and carrier requirements, including the Telephone Consumer Protection Act, the CAN-SPAM Act, U.S. A2P 10DLC registration requirements, and the policies of the carriers and aggregators through which messages are delivered. You must obtain and maintain appropriate consent from each recipient before sending non-emergency SMS or voice communications.

Meet Pete provides tools to help you comply (consent capture, opt-out handling, audit logs), but the obligation to comply rests with you. Use of the Services constitutes your representation that all messages you send are lawful and consented to.

6. Fees and payment

Fees for the Services are described in your order form, plan selection, or pricing page. Unless stated otherwise, fees are billed in advance, non-refundable, and exclusive of taxes. Late payments accrue interest at 1.5% per month or the maximum rate permitted by law, whichever is lower. We may suspend the Services for non-payment after notice.

7. Intellectual property

Meet Pete and its licensors retain all right, title, and interest in and to the Services, the Meet Pete brand, the underlying software, and all associated intellectual property. These Terms do not transfer ownership of any of the foregoing. You may not use Meet Pete trademarks without our prior written consent.

8. Confidentiality

Each party agrees to protect the other party's confidential information using at least the same degree of care it uses to protect its own confidential information of a similar nature, and at minimum a reasonable degree of care. Confidential information may be used only to perform under these Terms and disclosed only to personnel and contractors with a need to know.

9. Warranties & disclaimers

The Services are provided "as is" and "as available." Except as expressly set forth in these Terms or in a separate written agreement, Meet Pete disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that messages will be delivered without delay.

10. Limitation of liability

To the maximum extent permitted by law, in no event will Meet Pete be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to these Terms or the Services, even if advised of the possibility. Meet Pete's total aggregate liability arising out of or related to these Terms will not exceed the greater of (a) the fees paid by you to Meet Pete in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Meet Pete, its affiliates, and their respective officers, directors, employees, and agents from any third-party claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your use of the Services, (ii) your Customer Data, (iii) your violation of these Terms, (iv) your violation of any law or third-party right, including SMS, voice, and consumer-protection laws, or (v) any communication you send through the Services.

12. Term and termination

These Terms remain in effect for as long as you use the Services. You may terminate at any time by closing your account. We may suspend or terminate your access for violation of these Terms, non-payment, or risk to the platform, with or without notice. Upon termination, your right to use the Services ends; sections that by their nature should survive termination will survive.

13. Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising from or relating to these Terms is the state or federal courts located in King County, Washington, and the parties consent to the personal jurisdiction of those courts. Each party waives any right to a jury trial to the maximum extent permitted by law.

14. Changes

We may update these Terms from time to time. The "Effective" date at the top reflects the most recent revision. Material changes will be communicated to active customers via the contact email on file at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
